Federal Court Orders Release of Abrego Garcia from Immigration Custody
A federal judge has ordered the prompt release of Kilmar Abrego Garcia from immigration custody, concluding his ongoing detainment is without legal authority.
"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been re-detained, again without lawful authority," the judge stated in her order.
The situation stems from a mistaken removal to El Salvador earlier this year, which the government later acknowledged was an error. Following his repatriation to the United States to answer alien smuggling charges, he was held in federal custody.
In her order, the judge noted that the government does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."
